Laguna Niguel, CA – On Friday, June 24, 2022, the City of Laguna Niguel initiated litigation against the Bear Brand Ranch Community Association due to the Association's illegal blocking of public access to the Long View Park Trail.
The Long View Park Trail is a part of the City of Laguna Niguel's well-established trail system and must remain accessible to the general public. To date, the City's ongoing efforts to work with the Association to restore public access have been unsuccessful.
The lawsuit filed by the City seeks to require the Association to take corrective actions to its fencing at the northernly end of the Long View Park Trail.
The filing seeks a court order to preclude the Association from taking any further action to block the Trail, including prohibiting the Association from putting up fence panels that block public access at locations including, but not limited to, trail connections to the north of the Bear Brand neighborhood.
It also seeks an order to require the removal of an illegal gate and chain link fence segment, to increase the opening in that fence as is required by an existing public trail easement held by the City, to ensure the free and unimpeded use of the Long View Park Trail at that location, and to permit any remaining portions of the fence in accordance with City regulations.
